Charge Point Audit – Terms of Online Purchase

Draft — not yet in force

These terms are awaiting legal review and do not yet apply to any purchase. Buying an audit online is not yet available — please call us on 07356 112 325 and we will arrange it and confirm the terms with you directly.

Version 1.0 – DRAFT, pending legal review

Drafted: 08/09/26

1. About these terms

1.1 These terms apply where you buy a Charge Point Audit from us on our website and pay for it online by card. They tell you who we are, what you are buying, when and how you can cancel, and how we refund you.

1.2 Our Standard Terms & Conditions of Purchase also apply to the Audit, but only so far as they are consistent with these terms and with us supplying the Audit to you. Where the two conflict, these terms prevail. In particular, these terms replace clause 3 (Price), clause 4.1 (payment within 7 days of invoice) and clause 15.2.2 (liability capped at the value of the Order) of those terms, because an online Audit has a published fixed price, is paid for in full before we attend, and is a safety inspection.

1.3 Please read these terms before you pay. You will be asked to accept them at the checkout, and this page stays available at the same address so you can come back to them at any time.

1.4 If you are a Consumer, nothing in these terms affects your legal rights. Where these terms give you less than the law gives you, the law applies.

3. What you are buying

3.1 An Audit comprises an on-site inspection of the charge points at the site address you give us, and a written Report setting out our findings on compliance and safety together with recommendations for any remedial work.

3.2 The Audit Fee covers one visit to one site with up to 50 charge points. If your charge points are at more than one site, each site needs its own Audit.

3.3 The Audit is an inspection and reporting service. It does not include carrying out remedial work, and the Report is not a certificate, guarantee or warranty that your charge points are or will remain compliant. We will tell you what we found on the day we attended.

3.4 We will carry out the Audit using reasonable care and skill, by suitably competent personnel.

4. Price and payment

4.1 The Audit Fee is £500 plus VAT, which is £600 in total at the current standard rate of 20%. VAT is added at the checkout at the rate in force, and the total you pay is shown to you before you confirm the payment.

4.2 The Audit Fee is payable in full at the time you place your Order. This replaces clause 4.1 of our Standard Terms & Conditions of Purchase for online Audits.

4.3 Payment is taken by card through our Payment Provider. We do not receive or store your card details.

4.4 Our Payment Provider will email you a receipt showing the VAT charged. Please keep it, and quote the payment reference shown on it if you contact us about your payment.

4.5 If the price shown on our website was obviously wrong and you could reasonably have recognised it as a mistake, we may cancel your Order, refund you in full under clause 9, and treat the Order as never having been placed.

5. When your contract with us starts

5.1 Our contract with you is made when your card payment is confirmed as taken. The receipt our Payment Provider emails you is your written confirmation of it, and shows the date and the payment reference.

5.2 If it turns out we cannot carry out the Audit – for example because your site is outside the area we cover, or the charge points are not of a type we can inspect – we will tell you promptly, cancel your Order and refund you in full under clause 9. Nothing further will be owed by either of us.

6. The information we need from you

6.1 We cannot schedule your visit until you have given us the details of your site. We ask for these immediately after payment, and they include the full site address, the number of charge points, and where known their brand, model and serial numbers.

6.2 If you do not give us those details at the time of payment, please send them to us at hello@safercharging.co.uk. We will also contact you to ask for them.

6.3 You must give us information that is accurate and complete so far as you are aware.

6.4 If your site has more than 50 charge points, or if what you told us turns out to be materially wrong – for example there are far more charge points than the number you gave us – we will quote you for the additional work before we attend. You are free to say no: if you do, we cancel your Order and refund the Audit Fee in full. We will not attend and then present you with a larger bill.

6.5 If we have heard nothing from you for six months after your payment despite having asked you for your site details at least twice, we may cancel your Order and refund you in full under clause 9.

7. Arranging the visit

7.1 Once we have your site details we will contact you within one Working Day to agree a date for the visit.

7.2 We will use reasonable endeavours to attend on the agreed date. Times are estimates and are not guaranteed.

7.4 We will send your Report within 10 Working Days of the visit. If anything is going to make that impossible we will tell you before the deadline passes and agree a new date with you.

7.3 You must give us safe and unobstructed access to the charge points and to any areas we reasonably need to reach in order to inspect them, including areas containing electrical switchgear, and obtain any permissions needed for us to attend. Clause 12 of our Standard Terms & Conditions of Purchase sets out your obligations in more detail.

8. Changing or cancelling the visit

8.1 You can move or cancel an agreed visit free of charge. Just call or email us and we will rearrange it or refund you in full. There is no cancellation fee and no notice period.

8.2 There is one exception. If we have Mobilised and it is within 48 hours of the agreed appointment, we may deduct our reasonable costs actually incurred in mobilising — for example an engineer’s day we can no longer fill, or travel or accommodation we cannot recover. We will tell you what those costs are and why before we deduct anything, and we will only ever deduct what we have actually lost. This is the deduction contemplated by clause 12.2.3 of our Standard Terms & Conditions of Purchase.

8.3 The same applies if we attend as agreed and cannot carry out the Audit because nobody is there, we cannot get access, or the site is unsafe to work in. We have plainly incurred the cost of attending by that point, so we may deduct our reasonable costs of that visit on the same basis as clause 8.2.

8.4 We will not charge you anything for a visit that could not go ahead for a reason beyond your reasonable control, and we would always rather rearrange than charge you. In practice we expect clauses 8.2 and 8.3 to be rare.

8.5 If you are a Consumer, clause 10 applies to you and nothing in this clause 8 reduces your rights under it.

9. If we cancel, or cannot attend

9.1 If we cancel your Order, or cannot attend on the agreed date and cannot offer you an alternative date you are willing to accept, you may choose either a new date or a full refund of the Audit Fee.

9.2 We will not charge you anything for cancelling or rearranging in these circumstances.

9.3 We may cancel your Order and refund you in full at any time before we attend, including in the circumstances described in clauses 5.2, 6.4 and 6.5.

10. Your right to cancel – Consumers

10.1 This clause 10 applies only if you are a Consumer. It gives you rights under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 because you bought online.

10.2 You have 14 days, starting the day after your payment is taken, in which to change your mind and cancel, for any reason, and get your money back.

10.3 To cancel, just tell us before that period ends – email hello@safercharging.co.uk or call 07356 112 325. You do not have to give a reason. Telling us in writing is easiest for both of us because it fixes the date, but a phone call is enough.

10.4 We will not attend your site within that 14 day period unless you ask us to. You can ask us to by ticking the box offered on the site details form after payment, or by telling us in writing at any time. If you do ask us to attend sooner, you are making an express request for us to begin the Audit during the cancellation period, and:

10.4.1 you keep your right to cancel until the Audit has been fully performed; but

10.4.2 if you cancel after we have started, we may keep or charge a proportionate amount for what we had already done, based on the Audit Fee; and

10.4.3 once we have fully performed the Audit and issued your Report, you lose the right to cancel.

10.5 Where you have asked us to attend within the 14 days, we will set out clause 10.4 again in the email confirming your visit date, so it is never a surprise. If you have not asked us to, we will not offer you a date inside that period.

10.6 If you cancel under this clause we will refund you within 14 days of being told, under clause 12.

10.7 This right to cancel is in addition to, and does not affect, your other legal rights, including those in clause 13.

11. Cancelling – Business Customers

11.1 This clause 11 applies only if you are a Business Customer. The statutory right to cancel in clause 10 does not apply to you, because it is a consumer right. What follows is what we offer instead.

11.2 You may cancel your Order at any time before we have issued your Report, and we will refund the Audit Fee:

11.2.1 in full, in every case except those in clauses 11.2.2 and 11.2.3;

11.2.2 less our reasonable costs actually incurred, if we have Mobilised and it is within 48 hours of the agreed appointment, as set out in clause 8.2;

11.2.3 less our reasonable costs of the work already done, if you tell us after we have attended but before we have issued the Report.

11.3 Once we have issued your Report the Audit has been performed in full and the Audit Fee is not refundable, save where clause 13.2 applies.

11.4 We may also cancel your Order, as set out in clause 9.3.

12. How we refund you

12.1 We refund to the card you paid with, through our Payment Provider. We cannot refund to a different card or by another method.

12.2 We will make any refund without undue delay and in any event within 14 days of the day you tell us you are cancelling, or, where we are the ones cancelling, of the day we tell you. How long it then takes to appear on your statement is a matter for your card issuer, and is usually a few Working Days.

12.3 We do not deduct card processing fees from refunds. Any deduction will only ever be one this document expressly provides for, and we will tell you what it is and why before we make it.

13. If something is wrong with the Audit

13.1 If you are a Consumer, the Consumer Rights Act 2015 gives you rights we cannot exclude. Among other things the Audit must be carried out with reasonable care and skill, and if it is not you can require us to perform it again or, where that is impossible or we do not do it within a reasonable time, claim a price reduction.

13.2 Whether you are a Consumer or a Business Customer, if we have not carried out the Audit with reasonable care and skill, we will put it right – by re-attending and reissuing the Report at our cost, or, where that is not appropriate, by refunding you all or part of the Audit Fee.

13.3 Please tell us as soon as you can, and ideally within 30 days of receiving your Report, so that we can look into it while the site is still as we found it. Telling us later does not stop you claiming: this is a request, not a time limit, and it does not shorten any period the law allows you.

14. Complaints

14.1 If you are unhappy with anything we have done, please email hello@safercharging.co.uk or call 07356 112 325 and tell us what has gone wrong.

14.2 We will acknowledge your complaint within two Working Days and give you a full response within ten Working Days. If we need longer we will tell you why and when to expect an answer.

14.3 Raising a complaint does not affect your legal rights, and does not stop you taking the matter to court.

15. Our liability

15.1 Clause 15 of our Standard Terms & Conditions of Purchase applies to the Audit, except that, for an Audit bought online, our total liability is limited instead to the amount recoverable under our professional indemnity insurance in respect of the claim, and in any event to not less than the Audit Fee. We maintain that insurance under clause 18 of those terms and will confirm the level of cover on request.

15.1A This replaces the cap at the value of the Order in clause 15.2.2 of those terms. An audit of charge point safety is not worth capping at its own fee, and we do not ask you to accept that.

15.2 Nothing in these terms or in those terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else which cannot lawfully be limited or excluded – including, if you are a Consumer, your rights under the Consumer Rights Act 2015.

15.3 We are not liable for the condition of your charge points, or for any loss arising from a defect that existed before we attended. The Audit tells you what we found; it does not make us responsible for it.

16. Your information

16.1 We use the details you give us to arrange and carry out your Audit, to issue your Report, and to contact you about it. Our Privacy Notice explains what we do with your personal data and what rights you have.

16.2 Your card details are handled by our Payment Provider under its own terms and privacy policy. We never see them.

17. Transferring this contract

17.1 You may not transfer your Order to anyone else without our written agreement. We will not withhold it unreasonably – for example where the site has changed hands and the new owner wants the Audit you paid for.

18. Law and jurisdiction

18.1 These terms are governed by the law of England and Wales.

18.2 The courts of England and Wales have exclusive jurisdiction over any dispute arising out of these terms, except that if you are a Consumer resident in Scotland or Northern Ireland you may also bring proceedings in the courts of the country in which you live.
